The first step in determining if you are eligible for an expungement will depend on if your arrest or charge occurred in Kansas or Missouri.

Missouri Expungements in General

In Missouri, there are numerous misdemeanor and felony offenses that are eligible for expungement.  A complete list of offenses that are not eligible can be found at §610.140.

Please note, in the past, Missouri had a narrow expungement statute that only offered relief to a small handful of individuals. Recently, Missouri expanded its expungement statute to allow relief to a much wider group of people. If you have previously been told that your Missouri arrest or conviction was not eligible for expungement, you may now be eligible for relief given these recent changes to the law.

A person must wait seven years from the completion of a sentence to apply for expungement in a felony case and three years from the completion of a sentence in a misdemeanor case. Expungement under §610.140 of arrest records and convictions allow a person’s arrest record and/or conviction to be expunged and then sealed. Expungement of arrest records under 610.122 allow the arrest records to be expunged and then destroyed.

Kansas Expungements in General

In Kansas, expungements are available 3 years after the completion of a sentence for  any person convicted of a traffic infraction, cigarette or tobacco infraction, misdemeanor or a class D or E felony, or for crimes committed on or after July 1, 1993, any felony ranked severity levels 6 through 10 of the non-drug grid, any felony ranked in severity level 4 of the drug grid for crimes prior to July 1, 2012, and any felony ranked in severity level 5 of the drug grid from crimes after July 1, 2012.

A person must wait 5 years from the completion of a sentence for expungement if such person was convicted of a class A, B or C felony, or for crimes committed on or after July 1, 1993, any felony ranked in severity levels 1 through 5 of the non-drug grid, any felony ranked in severity levels 1 through 3 of the drug grid for crimes prior to July 1, 2012, and any felony ranked in severity levels 1 through 4 of the drug grid for crimes after July 1, 2013. A list of offense not eligible for expungement in Kansas can be found at K.S.A. 21-6614(e).
